Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.
1. Eligibility. Warner Brothers Records’ Ashley Tisdale Scavenger Hunt contest (the “Contest”) is open only to legal residents of the forty-eight (48) contiguous continental United States and the District of Columbia, who are thirteen (13) years of age or older at the time of entry (“Contestant”). Contestants must: (1) Follow Ashley Tisdale on Twitter at http://Twitter.com/AshleyTisdale; (2) Subscribe to Ashley Tisdale’s YouTube Channel (http://www.youtube.com/AshleyTisdale); (3) Become a fan of Ashley Tisdale on Facebook at http://www.facebook.com/AshleyTisdale; and (4) Add http://www.myspace.com/AshleyTisdale as one of their friends on MySpace. Employees and trustees of Warner Music Group, or their affiliates, subsidiaries, members, agents, and advertising or promotion agencies, and members of the immediate families (defined as including parents, spouse, children, siblings, grandparents, and each of their respective spouses) or households (whether related or not) of any of the above are NOT eligible to participate as Contestants in the Contest. Sponsors reserve the right, at any time, to verify Contestant eligibility in any manner they deem appropriate. Participation constitutes each Contestant’s full and unconditional agreement to these Official Rules and the Sponsors’ decisions, which are final and binding in all matters related to the Contest. This Contest or any particular rule of the Contest is void where prohibited by law.
2. Program Description. Internet access is required for participation. Contestants search for clues on the Internet throughout the Entry Period, with the final clue being released on the final day of the Entry Period.
3. Entry Period. The Contest begins on or about 12:00 noon PST on July 17, 2009, and ends at 3:00 PM PST on July 28, 2009 (“Entry Period”).
4. Prize. (3 total): Grand Prize (1): a pair of admission tickets and meet and greet passes to the Artist’s concert nearest winner’s home. Approximate Retail Value (“ARV”) of Grand Prize: $1,000.00. Airfare and hotel accommodations will be provided if the Grand Prize winner lives outside of a 100 mile radius of the concert location and at the sole discretion of Sponsors. If the Grand Prize winner lives within a 100 mile radius of the concert location, Sponsors reserve the right to supply alternate transportation in their sole discretion with no further obligation to the winner. In the event the concert nearest the Grand Prize winner’s home cannot be fulfilled due to reasons beyond Sponsors’ control, Sponsors reserve the right to offer the Grand Prize winner an alternate concert date/venue. Grand Prize value depends on winner’s place of residence and cost and availability of airfare and hotel at time of booking and travel and may be substantially higher or lower than the stated ARV. Should travel be necessary, trip dates will be specified by the Contest Entities. Failure to travel on the dates specified by the Contest Entities may result in forfeiture of the prize. Grand Prize Winner and travel companion agree that they undertake the trip at their own risk. Grand Prize Winner and travel companion must travel together on the same itinerary, including the same departure date, destination and return date and must have valid travel documents (e.g., valid government issued photo ID) prior to departure. Failure to do so will result in forfeiture of prize. Travel companion must complete a travel guest liability/publicity release prior to the trip. Grand Prize Winner’s travel companion must be the age of majority in his or her state of residence or Grand Prize Winner must be travel companion’s parent or legal guardian and must complete and return all releases on behalf of minor. In the event the Grand Prize Winner is a Minor, he/she must be accompanied by his/her parent/legal guardian on the trip. Contest Entities will not replace any lost or stolen tickets, travel vouchers or certificates. Once travel commences, no unscheduled stopovers are permitted; if an unscheduled stopover occurs, full fare will be charged from stopover point for the remaining segments, including return, of the trip. Contest Entities are not liable for any expenses incurred as a consequence of flight cancellation/delay. All air transportation tickets are subject to the vagaries of flight variation, work stoppages and schedule or route changes. ARV for travel prizes may vary depending upon points of departure and destination and fare fluctuations. Prize winner will not receive cash or any other form of compensation if actual travel costs are less than the prize ARV in these Official Rules. Sponsor reserves the right to structure the travel route and select hotels in its sole discretion. Trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. Second Prize (1): an Artist designed Flip camera. ARV of Second Prize: $250. Third Prize (10): an Artist autographed poster and "Guilty Pleasure" CD. ARV of Third Prize: $40. ARV of all Prizes: $1,650.00.
Upon the release of all the video clues on July 28th, the Contest form will be available for entries. Winners will be randomly chosen from Contestants who have followed all Contest instructions and answered all Contest questions correctly. The odds of winning the grand prize depend on the total amount of people who enter the Contest.
No cash or other substitution of prizes is permitted, except at the sole option of Warner Bros. Records or for a prize of equal or greater value. [Prizes won by minors will be awarded to the parents or legal guardians, who must sign all, if any required affidavits and releases.] Warner Bros. Records will not replace any lost or stolen prizes. Winners are solely responsible for any and all federal, state, provincial and local taxes, if any, that apply to prizes.
Sponsor will endeavor to confirm with the Contest Winner the details of fulfilling the Prize following the determination of the Contest Winner’s success in winning the Contest. Failure to coordinate with the Sponsor the details and logistics of the Prize will result in disqualification and Prize forfeiture. All Contestants must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, the Contest Coordinator will award the applicable Prize to the next person to submit all answers to the clues correctly among all remaining eligible entries. The process will be repeated until the Prize is awarded.
5. General Conditions. No responsibility is assumed by Sponsor for lost, late acquired or misdirected clues or any technical malfunctions that may occur. Determination of the Contest Winner will be conducted under the supervision of Sponsor, whose decisions are final. Odds of winning the Prize depend on the skill of the Contestant relative to all other contestants in finding the answers to all of the clues. Prizes are not redeemable for cash. No substitution, transfer, or assignment of prize permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value in the event an offered prize is unavailable for any reason. All expenses not specifically mentioned herein are the sole responsibility of the Winner. ALL FEDERAL, STATE AND LOCAL INCOME TAXES AND/OR OTHER EXPENSES, DUTIES, FEES, EXCISES OR TARIFFS, IF ANY, NOW OR HEREAFTER IMPOSED, NOT SPECIFICALLY AWARDED HEREIN AS PART OF THE PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER AND SAID WINNER WILL BE ISSUE AN IRS FORM 1099 (ALSO SUBMITTED TO THE UNITED STATES INTERNAL REVENUE SERVICE) FOR THE VALUE OF THE PRIZE. If a Contestant changes his or her contact information, it is the Contestant’s responsibility to notify the Sponsor of the updated information. Contestants agree to abide by the terms of these Official Rules and by the decisions of Sponsor, which are final and binding on all matters pertaining to this Contest. Sponsor will endeavor to remove disqualifying entries from the drawing pool, but it cannot guarantee that all disqualified entries will, in fact, be removed. This Contest is governed by the laws of the United States. All federal, state and local laws and regulations apply.
Sponsor reserves the right to void any participation effected through any robotic, automatic, mechanical, programmed, or similar method.
If, in the Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt of affect the administration, integrity, security, or fairness of the Contest, or if technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Contest, the Sponsor at its sole discretion reserves the right to disqualify any individual involved in such activity and to modify or suspend the Contest, or to terminate the Contest. Should the Contest be terminated prior to the state end date, notice of such termination will be posted on the Contest Web Site, and Sponsor may proceed to select a winner through other legal means. Any attempt by a Contestant or any other individual to deliberately damage the Web Site or otherwise undermine the legitimate operation of the Contest is unlawful; and, should such an attempt be made, Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.
FAILURE BY THE WINNER TO COMPLY WITH THESE OFFICIAL RULES IN ANY WAY, AS DETERMINED BY SPONSOR, WILL RESULT IN DISQUALIFICATION AND FORFEITURE OF ALL RIGHTS IN AND TO THE PRIZE.
6. Verification of Contest Winner and Release Except where prohibited, Contest Winner will be required to execute an affidavit of eligibility and liability/publicity release within seven (7) days following the date of receipt of such form and before receipt of use of the Prize. Non-compliance within this time period will result in disqualification and forfeiture of the Prize, and the Sponsor will proceed to acknowledge an alternate winner as indicated herein. Return of any prize or prize notification as undeliverable may result in disqualification and selection of an alternate winner. Contest Winner further grants to Sponsor the right to use and publish the Contests Winner’s proper name, hometown and state online and in print in any other media in connection with the contest. Acceptance of a prize constitutes permission for Sponsor to use Contest Winner’s name and likeness in any format and medium deemed appropriate by Sponsor in its sole discretion for advertising and promotional purposes without additional compensation and without notice unless such use is prohibited by law. By entering the Contest, Contestant releases and holds harmless Sponsor Entities from any and all liability or any injuries, loss or damage of any kind arising from or in connection with this Contest and/or any Prize won. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the registration process or the operation of the Contest.
7. NATURE OF RELATIONSHIP/WAIVER OF EQUITABLE RELIEF: Each Entrant acknowledges that, with respect to any claim by Entrant relating to or arising out of a Contest Entities’ actual or alleged exploitation or use of any Submission or other material submitted in connection with the Contest, the damage, if any, thereby caused to the applicable Entrant will not be irreparable or otherwise sufficient to entitle such Entrant to seek injunctive or other equitable relief or in any way enjoin the production, distribution, exhibition or other exploitation of the Submission or any other production based on or allegedly based on the Submission, and the Entrant’s rights and remedies in any such event shall be strictly limited to the right to recover damages, if any, in an action at law.
8. RIGHTS OF CONTEST ENTITIES/ DISCLAIMER OF LIABILITY: Contest Entities, shall have the right and sole discretion to edit, to refuse to post, or cease to post any Submission whatsoever which it finds to be in violation of the Official Rules, does not fully comply with all of Contest Entities’ requirements in connection with any and all legal clearance issues, or which it finds in its sole discretion to be otherwise objectionable for any reason. The Contest Entities also reserve the right to replace the winning Submission with the Submission of an alternate eligible Entrant in accordance with these Official Rules if such Submission and/or Entrant is withdrawn from or removed from the Contest for any reason, including without limitation, Entrant’s failure to have documents executed as directed by the Contest Entities. Contest Entities also reserve the right, in their sole discretion, to adjust times and dates reflected in the Description Section of the Official Rules at any time and/or to terminate the Contest for any reason in the event that there is an error, problem or cause which impacts the operation, administration or security of the Contest or the Contest Entities and, in such situation, to select the winner(s) from the eligible Submissions received prior to the action taken or in such manner as deemed fair and appropriate by Contest Entities in their sole discretion. The Contest Entities are not responsible for any Materials provided by Entrants which are deemed harmful or offensive to others or for any harm incurred as a result of the creation of any Submission. The Contest Entities make no warranties, express or implied, as to the content or the accuracy or reliability of any information or statements contained in the Submission. All statements and opinions made by Entrants are those of such Entrants only, and the Contest Entities neither endorse nor shall be held responsible for the reliability or accuracy of same. Contest Entities are not responsible for the content or practices of third party Web sites that may be linked to the Contest website. This site may also be linked to Web sites operated by companies affiliated with Contest Entities. Visitors to those sites should refer to each site’s separate privacy policies and practices.
9. INDEMNITY: The Contest may also be promoted by a third party or parties (each a “Promotional Partner,” collectively “Promotional Partners”). Entrants shall indemnify, defend and hold harmless the Contest Entities, any Promotional Partners, and each of their respective parents, affiliates, successors, assigns and licensees, and each of their respective employees, shareholders, officers, directors, contractors, agents and representatives from and against any and all liability, claims, loss, damage, injury or expense, including reasonable attorneys’ fees, arising in connection with any third party action arising out of a breach or allegation which if true would constitute a breach of any of Entrant’s representations, warranties or obligations herein.
10. GENERAL TERMS AND CONDITIONS: By participating, each Entrant agrees that the Contest Entities and each of their respective agents, representatives, parent companies, affiliates, subsidiaries and legal advisors, and each of their respective employees, shareholders, officers, and directors are not responsible or liable for, and shall be released and held harmless from: (i) late, lost, delayed, damaged, incomplete, illegible, unintelligible, misdirected or otherwise undeliverable mail, postage-due notices, release forms, affidavits or other correspondence; (ii) telephone, electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind; (iii) any condition caused by events beyond the control of the Contest Entities that may cause the Contest to be disrupted or corrupted; (iv) any printing, human, typographical or other errors or ambiguities in (or involving) any materials associated with the Contest; (v) any and all losses, damages, rights, claims and action of any kind in connection with or resulting from participation in the Contest; (vi) acceptance, possession, use or misuse of any prize, including, without limitation, personal injury, death and property damage arising there from; and (vii) claims based on publicity rights, defamation or invasion of privacy. By participating in the Contest, Entrants agree: (i) to be bound by these complete Official Rules and the decisions of Contest Entities which shall be final and binding; and (ii) to waive any right to claim ambiguity in the Contest or these Official Rules. By participating in the Contest and/or the receipt of any prize, entrants agree to release, indemnify, defend and hold harmless the Released Parties from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest, or receipt or use or misuse of any prize.
Contest Entities reserve the right, in their sole discretion, to adjust times and dates reflected in the Description Section of the Official Rules at any time and/or to suspend or cancel the Contest at any time for any reason, including, without limitation, if a computer virus, bug or other technical problem corrupts the administration, security, or proper conduct of the Contest, strikes, lock-outs, acts of God, technical difficulties, and other events not within the reasonable control of Contest Entities. If the Contest is terminated before the designated end date, Sponsor will (if possible) select the winners from all eligible, non-suspect Submissions received as of the date of the event giving rise to termination. Contest Entities reserve the right, at their sole discretion, to prohibit any Entrant from participating in the Contest or to disqualify any individual it finds, in its sole determination, to be tampering with the entry process or the operation of the Contest; to be attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or any other unfair playing practices; to be acting in violation of the Official Rules; or to be acting in a disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Contest Entities may suspend or discontinue the Contest if, in their sole opinion, there is any actual or suspected tampering of the Contest, or any other malfunction, event or activity that may affect the integrity of the Contest. CONTEST ENTITIES SHALL NOT BE OBLIGATED TO AWARD ANY PRIZE THAT RELATES TO OR ARISES OUT OF IMPROPER OR MISTAKEN PRIZE NOTIFICATION, OPERATION OR FUNCTION OF THIS CONTEST. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
11. DISPUTES: All issues and questions concerning the construction, validity, interpretation and enforceability of the Contest, or the rights and obligations of Entrants and the Contest Entities in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of California or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of California. In the event of a claim or dispute, Entrants’ sole remedy shall be limited to their remedy at law for damages, if any, and Entrants shall not have the right to in any way enjoin or restrain the distribution, advertising, publicizing or other exploitation (in any form of media) of the Website, the Contest, and/or any intellectual property owned or licensed by the Contest Entities or their respective parent companies and affiliated entities.
12. PRIVACY POLICY: Any personal information supplied by any Entrant to MySpace will be subject to Warner Bros. Records' privacy policy posted at http://warnerbrosrecords.com/privacy-policy. By entering the Contest, the Entrant grants Warner Bros. Records permission to share your email address and any other personally identifiable information with the corresponding Contest Entities solely for the purpose of eligibility, judging and prize fulfillment. MySpace will not sell, rent, transfer or otherwise disclose your personal data to any third party other than the corresponding Contest Entities as described above herein.
13. WINNERS/OFFICIAL RULES: To obtain a copy of the Winner’s List or a copy of these Official Rules, send your request along with a stamped, self-addressed envelope to: Ashley Tisdale Get A Clue Contest Winners/Rules, 3300 Warner Blvd. Burbank CA 91505. Requests for the names of the winners must be received no later than August 31, 2009. Vermont residents may omit return postage.
